Penalties for Violent Offenses

The possible penalties for a violent crime conviction in Texas depend on various factors, not least of which is how the offense is charged.

Some of the factors that affect the potential penalties for a violent criminal offense include:

  • The nature of the offense and the violence involved
  • The impact of the offense on the victim (severity of the injury, death, trauma, etc.)
  • The relationship between the alleged offender and victim
  • Whether a deadly weapon was used in the commission of the crime
  • Whether the alleged offender has any prior criminal history
  • The mental state of the alleged offender at the time of the crime
  • The motive behind the offense, including whether it was motivated by hate
  • The age of the alleged offender
  • The age of the victim

Depending on whether the offense is charged as a first-, second-, or third-degree felony, you could be looking at a prison sentence of 2-10, 2-20, or 5-99 years or life imprisonment if you are convicted. For a capital murder charge, you could even be facing the death penalty.
