What Is a Misdemeanor?

A misdemeanor is a criminal offense that is considered less serious than a felony and more serious than an infraction. In Texas, misdemeanors can result in fines, probation, community service, and up to one year in county jail.

Common misdemeanors in Texas include:

  • Driving while intoxicated (DWI)
  • Possession of under 4 oz of marijuana
  • Assault
  • Theft (under a certain dollar amount)
  • Criminal trespass
  • Disorderly conduct

Although misdemeanors are not considered as serious as felonies, being convicted of a misdemeanor can have a significant impact on your life. Because of this, it is crucial that you work with a knowledgeable defense attorney who knows how to protect your rights and your future.

How a Misdemeanor Conviction Can Impact Your Life

Just because misdemeanors are “less serious” than other types of criminal offenses, this does not mean that they are without serious, even life-altering consequences.

Being convicted of a misdemeanor can lead to:

  • Criminal Penalties: If convicted, you may face fines, probation, community service, and up to one year in county jail. These penalties can disrupt your life significantly, affecting your employment, finances, and personal freedom.
  • Damage to Your Reputation: A misdemeanor conviction can tarnish your reputation in your community and among your peers. It may lead to stigma and prejudice, making it difficult to rebuild trust and credibility.
  • Issues in Your Professional Life: Certain professions have strict standards regarding criminal records. A misdemeanor conviction could jeopardize your current job or future career prospects, particularly in fields such as education, healthcare, and law enforcement. It may also impact your ability to obtain or maintain certain professional licenses or certifications.
  • Limited Educational Opportunities: Some educational institutions conduct background checks as part of their admissions process. A misdemeanor conviction could potentially hinder your chances of acceptance into colleges, universities, or specialized programs.
  • Financial Consequences: Beyond fines imposed by the court, a misdemeanor conviction can lead to increased insurance premiums, difficulty obtaining loans or housing, and limitations on travel or immigration status.
  • Family and Personal Relationship Strain: The stress and strain of facing criminal charges can strain personal relationships with family and friends. It can also lead to emotional distress and uncertainty about your future.

Navigating the legal complexities of a misdemeanor charge requires experienced legal counsel. Our firm is committed to defending your rights and working to minimize the long-term consequences of a misdemeanor conviction.
